Welcome to SwipeSpell. These Terms of Service ("Terms") govern your use of the SwipeSpell mobile application ("App") operated by Next Please ("we", "our", or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

1. Acceptance of Terms

By accessing or using SwipeSpell, you confirm that you have read, understood, and agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.

2. Eligibility

SwipeSpell is intended for a general audience. If you are under 13 years of age, you may not use the App. If you are between 13 and 18, you may use the App only with the consent of a parent or legal guardian.

3. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal, non-commercial entertainment purposes, subject to these Terms.

You may not:

Copy, modify, distribute, or create derivative works of the App
Reverse-engineer, decompile, or disassemble the App
Remove or alter any proprietary notices or labels
Use the App for any commercial purpose without our written consent

4. User Conduct

When using SwipeSpell, you agree not to:

Use cheats, exploits, automation software, bots, hacks, mods, or any unauthorized third-party tools
Exploit bugs or glitches to gain an unfair advantage
Interfere with or disrupt the App or its servers
Attempt to gain unauthorized access to accounts, systems, or networks
Engage in any activity that violates applicable laws or regulations

We reserve the right to suspend or terminate your access to the App if you violate these Terms.

5. In-App Purchases

SwipeSpell offers optional in-app purchases ("IAP"), including virtual currency, boosters, and other digital items. By making a purchase:

All purchases are processed through Google Play and are subject to the Google Play Terms of Service
All sales are final unless otherwise required by applicable law
Virtual items have no real-world monetary value and cannot be exchanged, transferred, or refunded except as required by law
Prices are displayed in your local currency and may vary by region

6. Virtual Currency and Items

SwipeSpell features virtual currencies (gems and coins) and digital items (boosters, power-ups). These items:

Are licensed to you, not sold
Have no cash value outside the App
May not be transferred between accounts
May be modified, removed, or rebalanced at our discretion to improve gameplay

7. Advertisements

SwipeSpell displays advertisements, including interstitial and rewarded video ads. By using the App, you acknowledge that:

Ads are served by third-party networks and are subject to their own terms and privacy policies
We are not responsible for the content of third-party advertisements
You may purchase an ad-free experience through the App if available

8. Leaderboards and Play Games Services

SwipeSpell uses Google Play Games Services for leaderboards and achievements. By using these features:

Your display name and scores may be visible to other players
You agree to abide by the Google Play Games Terms of Service
We reserve the right to remove scores or achievements obtained through unfair means

9. Intellectual Property

All content in SwipeSpell, including but not limited to graphics, music, sound effects, text, game design, and code, is the property of Next Please or its licensors and is protected by applicable intellectual property laws.

The SwipeSpell name, logo, and related marks are trademarks of Next Please.

10. Disclaimer of Warranties

SwipeSpell is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. We do not guarantee that:

The App will be uninterrupted, error-free, or secure
Any defects will be corrected
The App will meet your specific expectations

11. Limitation of Liability

To the maximum extent permitted by applicable law, Next Please shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App, including but not limited to loss of data, loss of virtual items, or interruption of service.

Our total liability for any claims arising from your use of the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

12. Service Modifications

We reserve the right to:

Modify, update, or discontinue the App at any time
Change game mechanics, levels, difficulty, or content
Add, modify, or remove features, virtual items, or in-app purchase offerings
Perform maintenance that may temporarily limit availability

We will make reasonable efforts to provide advance notice of significant changes.

13. Termination

We may suspend or terminate your access to SwipeSpell at any time, with or without cause, and with or without notice. Upon termination:

Your license to use the App is immediately revoked
You lose access to any virtual items or currency associated with your account
Sections of these Terms that by their nature should survive termination will remain in effect

14. Governing Law

These Terms are governed by and construed in accordance with the laws of Poland, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the App shall be resolved in the courts of Poland.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

Posting updated Terms in the App or on our website
Updating the "Last Updated" date at the top

Continued use of the App after changes constitutes acceptance of the revised Terms.
